Welcome to Vibes254, an online marketplace that connects event organizers, experience hosts, and customers across Kenya. By accessing or using Vibes254, you agree to the following Terms & Conditions. Please read them carefully.

1. Introduction

Vibes254 (“we,” “us,” “our”) provides a platform where approved vendors (“Organizers”) can list, promote, and sell tickets or access to events and experiences. Customers (“Users”) can browse, purchase, and attend these events.

By using this platform, you confirm that:

  • You are at least 18 years old.
  • You agree to comply with all applicable Kenyan laws.
  • You agree to these Terms & Conditions and our Privacy Policy.

2. Platform Role & Responsibilities

Vibes254 is a marketplace and technology platform, not the organizer of events.

We:

  • Provide listing tools for vendors
  • Handle payment processing
  • Manage escrow payout timing
  • Offer customer support related to the platform

We do not:

  • Host or manage events
  • Control event safety
  • Verify physical venues
  • Guarantee event outcomes
  • Provide transportation or logistical services

Event organizers are fully responsible for the accuracy, safety, and delivery of their events.

3. Vendor (Organizer) Responsibilities

Organizers listing events on Vibes254 agree to:

  • Provide accurate event information (date, time, venue, age restrictions, safety requirements, etc.)
  • Honor all valid tickets and bookings
  • Notify customers promptly if event details change
  • Ensure events comply with safety, health, alcohol, and crowd-control regulations
  • Respond to customer inquiries in a timely manner
  • Take full responsibility for the quality and execution of their events

Organizers must not list:

  • Illegal events
  • Misleading information
  • Events that violate venue licensing laws
  • Duplicate or fraudulent listings

Vibes254 reserves the right to remove any event or suspend any vendor at our discretion.

4. Escrow & Payout Policy

To improve safety and prevent fraud, Vibes254 uses a secure payment-hold system:

4.1 Standard Payout

  • Earnings are held in escrow until after the event end date.
  • After the event is completed, funds become available for withdrawal.

4.2 Early Withdrawals

  • In some cases, early partial withdrawals may be allowed.
  • These are reviewed manually by Vibes254 and are not guaranteed.
  • Organizers must have a good standing history to qualify.

4.3 Withdrawal Limits

  • Organizers may be limited to one or two early withdrawal requests per event, depending on account status.

4.4 Commission Fees

  • Vibes254 charges a 10% commission per ticket sold.
  • Commission is automatically deducted before payout.

5. Event Cancellations & Refunds

5.1 Organizer-Initiated Cancellations

If an organizer cancels an event:

  • Customers receive a full refund.
  • Organizer earnings are not released.
  • Repeated cancellations may lead to removal from the platform.

5.2 Customer Refund Requests

Refunds may be issued if:

  • The event is cancelled
  • The date or venue is changed significantly
  • The event is materially different from the advertised description
  • The organizer fails to deliver the experience

All refund decisions are made at the discretion of Vibes254.

5.3 No-Show Policy

Customers who do not attend an event are not entitled to automatic refunds.

6. Ticketing & Entry

Users must present a valid ticket or QR code at the event entry point.

Organizers are responsible for:

  • Verifying tickets
  • Preventing duplicate or fraudulent entries
  • Managing crowd safety

Vibes254 is not responsible for issues arising at event gates.

7. Prohibited Activities

Users and organizers may not:

  • Resell Vibes254 tickets outside the platform
  • Use bots or fake accounts
  • Upload harmful code, scams, or misleading information
  • Harass other users or organizers
  • Attempt to bypass platform fees
  • Abuse the dispute or refund system

Violations may lead to account suspension or legal action.

8. Disclaimers & Limitation of Liability

Vibes254 is not responsible for:

  • Event safety, security, or crowd control
  • Venue conditions
  • Changes caused by weather, government restrictions, or emergencies
  • Personal injury, property loss, or damages occurring at any event
  • Loss of earnings due to event cancellations or low ticket sales

The platform is used at your own risk.

9. Account Termination

We may suspend or terminate accounts for reasons including:

  • Fraudulent activity
  • Violating these terms
  • Listing unsafe or illegal events
  • Repeated customer complaints
  • Payment or chargeback fraud

Terminated organizers may be permanently banned from using Vibes254.

10. Changes to Terms

Vibes254 may update these Terms & Conditions at any time. Continued use of the platform means you accept the updated terms.
